The Associated Journals Ltd. ‘AJL’ is continuously making progress with the enthusiasm of readers like you. The aim of AJL is to protect democratic values with fearless journalism. AJL is offering Indian and global readers of its digital publication an advertisement-free reading package(s).

These Terms and Conditions govern the relationship between AJL and each contributor, including the terms on which contribution may be accepted, refused, or returned by AJL. Contribution will be accepted in the form of a one-off payment or recurring monthly payments or annual payments made directly to AJL as described in these Terms and Conditions (‘Contribution’)

1. AGREEMENT

By paying the prescribed contribution amount, a person agrees and acknowledges that:

1.1 The Contribution paid is subject to these Terms and Conditions, which shall constitute a legally binding agreement between the contributor and AJL;

1.2 All Contributions made to AJL is voluntary, subject to any exercise of the contributor’s right to refund of the contribution as described below and AJL’s right to return any contribution at its discretion;

1.3 The Contribution will be for an advertisement free experience as per the respective plan availed by the contributor as mentioned in the contribution module;

1.4 The Contribution made will be inclusive of taxes, as and wherever applicable; and

1.5 AJL may at its sole discretion, withdraw, modify, or amend these Terms & Conditions at any time, with or without any prior notice.

2. RECURRING CONTRIBUTION

2.1 Contributor agrees to contribute on a rolling monthly basis. A contribution plan once selected by the contributor can be changed only after cancelling the previously selected plan;

2.2 Contributor must provide complete and accurate information at the time of agreeing to contribute on a recurring basis, monthly or annually;

2.3 Contribution/Payment can be made either through Credit Card/Debit Card/Net Banking;

2.4 The contribution/payments will be made by the contributors on a rolling (monthly or annual) basis. The contributors may also opt for a one-time payment; and

2.5 The recurring contribution shall continue until and unless revoked by the Contributor.

3.  ELIGIBILITY

Any individual who has attained 18 years of age or legal entity may become a ‘Contributor’ by making payment as stipulated in the contribution module.

4. ADMINISTRATION OF CONTRIBUTIONS

4.1 All contributions made to AJL shall be made through the Contribute pages on either  National Herald, Navjivan or Qaumi Awaz (the Website”). Contribution fee will be accepted by AJL for the period during which the Contribute page is live on the website;

4.2 The Contribution made by a contributor to AJL will be received by one of AJL’s payment providers and will be held by the provider until they are paid out to a regional AJL bank account together with other AJL funds;

4.3 Each contribution will be identifiable by a unique payment provider identification number and is non-refundable. The contribution can be accounted for separately by AJL, if and when required by a competent authority;

4.4 Once the contribution is processed, AJL will be legally and beneficially entitled to the full amount and the Contributor has no entitlement to the return of the said contribution amount in any circumstances other than as specified in these Terms & Conditions;

4.5 The Contributors shall receive an advertisement free experience of our website in consideration of their voluntary contribution.  Contributors/users shall have no rights to influence the editorial policy or output of AJL; and

4.6 Contributions made to AJL are not charitable donations under the laws of India and, as far as AJL is aware, contributor/user shall not be entitled to any tax relief in respect of their contribution. As far as AJL is aware, the contributions are not eligible for “gift aid” either in the India or in any other jurisdiction.

5. REFUND AND CANCELLATION OF CONTRIBUTION

5.1 AJL reserves all its rights right to refuse or return any contribution, in its absolute discretion, at any point of time, where it believes that accepting the contribution would be in conflict with its mission, vision, values or interests. AJL also reserves all its rights to refuse or return any contribution where AJL considers that to accept the contribution could damage the independence or reputation of AJL or adversely affect the relationship of AJL with other contributors or stakeholders due to the source of origin of the contribution or the intention of the contributor;

5.2 Contributors shall not be entitled to refund of their contribution after receipt by AJL;

5.3 Any refused or returned contribution shall be deposited in the account from which the contribution was originally paid; and

5.4 Recurring contributors can cancel their subscription any time, through their profile page on https://www.nationalheraldindia.com/contribute 

6. TRANSPARENCY

6.1 AJL reserves the right to:

6.1.1 request for the full name and contact details of the contributor;

6.1.2 request from the contributor any information that it may consider to be necessary or desirable to determine the provenance of the contribution; and

6.1.3 undertake any investigation as it may deem fit to determine the provenance of the contributor.

6.2 If any contributor refuses to provide any information requested by AJL under this clause, AJL may refuse or return the contribution at its discretion.

7. CONFIDENTIALITY AND PUBLICITY

Contributors shall not publicize their contribution or the payment made as contribution or otherwise market themselves, or any connected person or business, in connection with their contribution, except with the prior written consent of AJL.

8. DATA PROTECTION AND PRIVACY

9. EXCLUSION OF LIABILITY

AJL or its Directors, Key Managerial Personnel, employees, agents, officers or any person working for, employed by or affiliated with AJL shall not be held liable for any loss suffered including but not limited to loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, whether caused by tort (including negligence), breach of contract or otherwise by any contributor or any other person, whether directly or indirectly, or whether arising out of or in connection with AJL’s contribution or the payment of any amount as contribution.

10. MISCELLANEOUS

10.1 Any failure to assert any legal right or provision of law by AJL under these Terms and Conditions shall not constitute a waiver of that right or provision under any circumstances;

10.2 If any provision in these Terms and Conditions is held to be invalid, illegal or unenforceable for any reason by a court of competent jurisdiction, then that provision shall be eliminated or limited to the minimum extent and the remaining provisions of these Terms and Conditions will continue to be in force and effect;

10.3 These terms and conditions constitute a legally binding agreement between the contributor and AJL in respect of any contribution made by the contributor;

10.4 These Terms and Conditions neither create nor confirm any rights on any third party;

10.5 Any dispute, liability or obligation arising out of or under this Agreement and any non-contractual dispute, liability or obligation arising out of or in connection with this Agreement shall be governed by Indian Laws and shall be subject to the exclusive jurisdiction of  courts at New Delhi.

11. ARBITRATION

Any claim, dispute or difference relating to or arising out of this Agreement shall be referred to the arbitration, of a sole arbitrator to be appointed by AJL. The seat and venue of arbitration shall be New Delhi, India and the arbitration proceedings will be conducted in English language. The arbitration shall be subject to the Arbitration & Conciliation Act, 1996 (as amended till date).
