Delhi High Court orders PMO to file Affidavit on High Profile Bank Fraud Cases

Hon’ble Justice Rekha Palli of the High Court of Delhi ordered the Prime Minister’s Office to file an affidavit or statement in the matter of Prasenjit Bose Vs CPIO, Prime Minister’s Office [WP ( C ) 13776/2021].

The matter relates to an RTI application filed with the Prime Minister’s Office on 12.09.2018 seeking information on the list of high profile bank fraud cases submitted to the PMO by ex-Governor RBI, Dr. Raghuram Rajan. The CPIO, PMO withheld information on the list of bank frauds citing Section 45E of the RBI Act and Section 8(1)(h) of the RTI Act. An appeal was filed with the Chief Information Commissioner, where the PMO’s position was upheld. A writ petition was filed in the Delhi High Court on 30.11.2021 challenging the CIC order.

The Delhi High Court today orally indicated that Section 45E of the RBI Act was not applicable to the case where the information has already been parted with by RBI to the PMO. The CPIO, PMO has been instructed to file an affidavit justifying the exemption under Section 8(1)(h), giving details of the ongoing investigations with regard to the high profile bank fraud cases. The matter will be heard again on January 20.
